Can an Independent Mechanic Service My Car Without Voiding the Warranty?

Australian Consumer Law is clear: a dealer cannot void your warranty just because you chose an independent workshop. Here is what the law says — and what to keep on record.

One of the most persistent myths in car ownership is that you must return to the dealer for servicing to keep your warranty valid. It is not true — and dealers who tell you otherwise are misrepresenting Australian Consumer Law.

What Australian Consumer Law Actually Says

The Competition and Consumer Act 2010 (Cth) and the Australian Consumer Law (ACL) protect your right to choose where your car is serviced. A manufacturer's warranty cannot be voided simply because you used a licensed independent repairer rather than a dealership, provided the servicing is carried out correctly and to the manufacturer's specifications.

Under the ACL, a supplier cannot impose conditions on a statutory warranty that restrict your choice of repairer — so long as the work is done to the required standard with appropriate parts.

What You Must Do to Protect Your Warranty

  • Service at the manufacturer's specified intervals (distance and time)
  • Use genuine or OEM-equivalent parts that meet the manufacturer's specifications
  • Have your logbook stamped at each service
  • Keep all receipts and invoices from every service
  • Ensure the mechanic holds a current Motor Vehicle Repairer's Licence (MVRL) in NSW

What a Dealer Would Need to Prove to Void Your Warranty

If a warranty claim arises, the burden falls on the manufacturer or dealer to prove that independent servicing caused the defect — not just that it occurred. If your oil was changed to spec, your logbook was stamped and you kept receipts, that is a very high bar to meet. In practice, most dealers will not pursue this argument when the car has been properly maintained.

The Exception: Specialised or Approved-Repairer Requirements

Some high-voltage EV warranty provisions require work to be performed by certified or manufacturer-approved repairers — particularly for battery and high-voltage system warranty claims. This is a specific carve-out, not a general rule. Check your warranty booklet for your specific vehicle.
